SCOTT ALLEN BRANDON [#189654], 37, of Torrance was suspended for four years, stayed, placed on five years of probation with a 30-month suspension and until he proves his rehabilitation and was ordered take the MPRE and comply with rule 955. Credit shall be given for an interim suspension which began March 9, 2001. The order took effect July 12, 2002.

Brandon stipulated to misconduct in seven cases resulting from five separate criminal cases.

In 1999, he was convicted of driving under the influence, driving on a suspended license and possession of marijuana, all misdemeanors.

The following year, he was convicted of criminal charges in three proceedings. In January, he was convicted of giving false information to a peace officer and driving with a suspended license. In September, he pleaded guilty to possessing cocaine, a felony.

Two weeks later, Brandon ran a red light and when police tried to pull him over, he took off. In the ensuing car chase, he hit a police car. He pleaded guilty to felony assault on a police officer and misdemeanor DUI and was sentenced to 120 days in the county jail. In addition, his probation in the cocaine possession matter was revoked and he was sentenced to two years in prison.

The following year, he pleaded guilty to felony escape while misdemeanor charges were pending, a charge which resulted from his failure to show up for a work furlough program.

Brandon was placed on interim suspension and was ordered to comply with rule 955 by notifying his clients and co-counsel of his suspension and by returning their files and any unearned fees. He also was required to file an affidavit stating that he had done so. Because he was in prison, Brandon was unsure how to comply and upon his release he contacted the bar indicating he had no clients and had earned all fees owed him. He stipulated that he did not file a declaration of compliance with rule 955 on time.

In mitigation, Brandon has serious drug and alcohol problems, entered a sober-living facility, agreed to submit to random drug screening and phones his probation officer every night. He cooperated with the bar's investigation and he has no prior record of discipline although he has practiced less than five years.
