July 26, 2014 DANIEL BURT HALPERN [#189336], 43, of San Jose, was summarily disbarred July 26, 2014 and ordered to comply with rule 9.20 of the California Rules of Court. In June 2013, Halpern pleaded guilty to two counts of grand theft. Because the crimes are felonies involving moral turpitude, they met the criteria for summary disbarment.Halpern had one prior record of discipline, a 2012 suspension for three counts of misconduct in three matters. He was ordered to comply with rule 9.20 of the California Rules of Court. July 27, 2012 DANIEL BURT HALPERN, 41, of San Jose was suspended for one year, stayed, placed on one year of probation with a 30-day suspension, and he was ordered to take the MPRE. The order took effect July 27, 2012. Halpern stipulated to three counts of misconduct in three matters.He commingled funds in his client trust account, depositing personal funds to cover unearned fees he returned to a client. In the second matter, he sent to opposing counsel a client’s email that included his thoughts about a contested issue in his divorce case. Halpern stipulated that he failed to perform legal services competently.He also stipulated to failing to perform competently in the third matter, after he failed to respond to his client’s requests for information and unreasonably delayed filing the findings and an order for child and spousal support in an uncontested divorce.In mitigation, Halpern had no prior discipline record and he cooperated with the bar’s investigation. |
