LONNIE ROBERT MARKUM [#188338], 46, of San Diego was suspended for one year, stayed, placed on five years of probation with a 90-day actual suspension and was ordered to take the MPRE within one year and comply with rule 955. The order took effect June 29, 2006.

Markum was convicted in 2002 of vandalism, assault, filing a false crime report and driving without a license (all misdemeanors) and as part of a stipulation reached with the bar, he entered its alternative discipline program (ADP) for people with alcohol, drug or mental health issues. He was terminated from the program and discipline was imposed.

Participants in the ADP are required to also participate in the bar’s Lawyer Assistance Program (LAP). They stipulate that successful completion of the alternative discipline program means a lower level of discipline, but a harsher punishment will be imposed if the program is not completed.

Markum did not comply with the terms of his participation agreement with the LAP and he missed a lab test.

The convictions resulted from three separate incidents, all involving Markum’s drinking.
