ANDREW NICHOLAS DIMITRIOU [#187733], 45, of San Francisco, was suspended from the practice of law for one year and ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. He was also placed on three years’ probation and faces a two-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect May 10, 2015.

Dimitriou stipulated that he failed to maintain at least $17,523.60 of his client’s money from a settlement in his client trust account, negligently misappropriating it for his own purposes. In addition, he deposited $80,780 of his own money into the trust account and failed to timely and completely respond to his client’s request for an accounting. The client sent 13 letters and one email requesting an accounting.

In mitigation, Dimitriou paid the full amount in restitution, was having family problems at the time of his misconduct, presented evidence of his good character, had no prior record of discipline and entered into a prefiling stipulation with the State Bar.
