July 30, 2009 SCOTT G. BAKER [#187710], 43, of San Andreas was suspended for two years, stayed, actually suspended for one year and until he makes restitution and the State Bar Court grants a motion to terminate the suspension and he was ordered to comply with rule 9.20. If his suspension exceeds two years, he must prove his rehabilitation. The order took effect July 30, 2009. In a default proceeding, the State Bar Court found that Baker committed four acts of misconduct in a single matter. He was hired by a woman who had power of attorney for an elderly man suffering from Parkinson’s disease. The client believed another individual was engaging in elder abuse and asked Baker to file a civil action for conversion of the elderly man’s property.Although Baker prepared for and attended a hearing to obtain a restraining order, he never filed a civil suit, returned his client’s phone calls or refunded her unearned fees; eventually he closed his office and vanished. The State Bar assumed jurisdiction over his practice.The bar court found that he failed to perform legal services competently, communicate with his client or maintain a current address with the bar and he abandoned his client.Baker also was disciplined in 2008 for failing to return unearned fees.November 23, 2008 SCOTT GREGORY BAKER [#187710], 42, of San Andreas was suspended for one year, stayed, actually suspended for 30 days and until he makes restitution and was ordered to take the MPRE. If the actual suspension exceeds 90 days, he must comply with rule 955 and if it exceeds two years, he must prove his rehabilitation. The order took effect Nov. 23, 2008. In a default proceeding, the State Bar Court found that Baker failed to refund unearned fees to a client.Baker entered into a fee agreement with a client who hired him to handle her divorce; she gave him $1,750 as an advance fee. He missed a subsequent appointment with the client and when she had difficulty contacting him, she hired a new lawyer. Although Baker turned over the client’s file, he did not refund her fee. |
