February 14, 2014

BRADLEY LYNN JENSEN [#182272], 47, of Aliso Viejo was suspended for one year, stayed, placed on two years’ probation with an actual 120-day suspension and ordered to comply with rule 9.20 of the California Rules of Court. The order took effect Feb. 14, 2014.

Jensen pleaded no contest in 2011 to misdemeanor child endangerment for leaving his 9-month-old daughter in a hotel room crib for at least 40 minutes while he took his toddler son for a walk. The State Bar Court recommended Jensen be suspended for his actions, but the State Bar sought disbarment, arguing it was Jensen’s third discipline case and asserting that he had lied to police about how long he had been gone.

In concluding that Jensen’s misconduct did not warrant disbarment, a three-judge review panel wrote that there was no proof that Jensen lied to police and that its goal was not to impose punishment for a crime but to determine the proper professional discipline.

“Jensen’s isolated act of parental neglect demonstrates a serious lack of judgment about the safety of his child,” the panel wrote. “But it minimally constitutes grounds for professional discipline because it does not involve moral turpitude and is entirely unrelated to the practice of law.”

In mitigation, Jensen has performed extensive community service, showed remorse for his conduct and cooperated with the State Bar.

Jensen had two prior records of discipline, from 2007 and 2011. In October 2007, he was suspended for misconduct in a 2003 family law case. He filed a dissolution petition and prepared a marital settlement agreement, but incompetently failed to finalize the case.

The 2011 discipline was for filing a meritless opening appellate brief with the California Court of Appeal.

BRADLEY LYNN JENSEN [#182272], 45, of Aliso Viejo was suspended for one year, stayed, placed on two years of probation with a 30-day actual suspension and was ordered to take the MPRE within one year. The order took effect May 14, 2011.

Jensen successfully completed the Alternative Discipline Program after demonstrating a connection between his mental health issues and his misconduct. He stipulated to four counts of misconduct in two client matters.

In one matter, Jensen stipulated that he filed a meritless opening brief for a client and by doing so, he continued employment when he knew that the objective was to present an unwarranted claim. In the other matter, he stipulated that he committed acts of moral turpitude by writing and sending letters using another attorney’s name and signature without the other lawyer’s knowledge and he impersonated with the intent to mislead. He also tried to obtain an advantage in a civil dispute by threatening to pursue criminal “recourse.”

Jensen was disciplined in 2007 for failing to perform legal services competently. In mitigation, no clients were harmed and he had serious family problems.

BRADLEY LYNN JENSEN [#182272], 41, of Irvine was suspended for 90 days, stayed, placed one year of probation and was ordered to take the MPRE within one year. The order took effect Nov. 4, 2007.

Jensen stipulated that he did not finalize a marital dissolution and thus failed to perform legal services competently. Although he filed a dissolution petition and prepared a marital settlement agreement, he never finalized the divorce.

In mitigation, Jensen has no prior discipline record and refunded advanced fees to the client.
