EUGENIA YEHUD ZACKS-CARNEY [#181811], 52, of Okemos, Mich., was disbarred Aug. 6, 2015 and ordered to comply with rule 9.20 of the California Rules of Court and make restitution.

The State Bar Court found Carney culpable of failing to maintain client funds in a trust account, commingling personal funds in a client trust account, failing to account and committing acts of moral turpitude, including misrepresentation and misappropriation.

In 2006, Zacks-Carney agreed to represent her uncle and his then wife in a personal injury case. During the course of representing them, she misappropriated $22,880.50 of their settlement money, told them fees and costs related to their lawsuit had not been disbursed when she knew these statements were false and gave them written accountings of the funds that were not true.

Zacks-Carney was ordered to pay $1,874.55 plus interest in restitution. In mitigation, she presented evidence of her good character, cooperated with the State Bar and has participated in pro bono and community activities.

She had one prior record of discipline, a January 2000 public reproval for improperly withdrawing from employment.
