Discipline Summaries

December 21, 2005

ROBERT BRIAN WOODS [#178125], 49, of Woodland was disbarred Dec. 21, 2005, and was ordered to comply with rule 955 of the California Rules of Court.

Woods failed to comply with rule 955, as required by a 2004 disciplinary order. He did not submit to the Supreme Court an affidavit stating that he notified his clients and other pertinent parties of his suspension.

The underlying discipline was imposed for Woods’ failure to perform legal services competently, appear at court-ordered settlement conferences, pay sanctions or keep his address current with the State Bar.

August 7, 2004

ROBERT BRIAN WOODS [#178125], 48, of Woodland was suspended for two years, stayed, actually suspended for 120 days and until the State Bar Court grants a motion to terminate the suspension, and was ordered to take the MPRE and comply with rule 955. If the actual suspension exceeds two years, he must prove his rehabilitation. The order took effect Aug. 7, 2004.

In a default proceeding, the bar court found that Woods committed four acts of misconduct in a real estate matter. He filed a lawsuit, but did not appear at a settlement conference or file a settlement conference statement and was sanctioned $500.

He appeared at the continued settlement conference but did not pay the sanction. He did not appear at a subsequent conference, was sanctioned $1,500, and his client arranged for a new lawyer to substitute in to the case. The case settled.

The same client then hired Woods to prepare a living trust for her and paid him $500. When he did not prepare the trust, she twice asked for a refund. He did not respond until after she filed a complaint with the bar.

The bar court found that Woods disobeyed a court order, failed to perform legal services competently in two cases and did not keep his address current with the bar.
