PATRICK JAMES MANSHARDT, 46, of Los Angeles was suspended for three years, stayed, placed on three years of probation with an actual 18-month suspension and until he proves his rehabilitation and makes restitution, and he was ordered to comply with rule 9.20 of the California Rules of Court. The order took effect June 16, 2012.

Manshardt stipulated to 23 counts of misconduct in eight matters, many involving practicing while suspended. He was suspended for four separate periods between 2006 and 2011; some suspensions were imposed for not paying bar dues and failing to make child and family support payments.

Beginning in 2004, Manshardt represented 12 San Francisco police officers who claimed reverse discrimination by the police department. He settled the case for $1.6 million, but only by promising one plaintiff she would receive $60,000 while another received $50,000. Manshardt said he would pay her the additional $10,000 from his fees. He never did so, did not refund her $1,000 in costs and did not return her phone calls. He also concealed the arrangement from a plaintiff who received less.

Seven officers who were unhappy with the terms of the settlement hired another lawyer and the matter went to arbitration. Manshardt was suspended at the time but held himself out as entitled to practice and filed an arbitration statement. He stipulated that he committed acts of moral turpitude, practiced while not entitled, misappropriated client funds, and failed to pay out client funds, communicate with a client or cooperate with the bar’s investigation.

He filed or handled other legal matters while suspended. In one matter, he was found in contempt and failed to pay court-ordered sanctions and attorney’s fees. He filed a federal lawsuit after he was removed from the rolls of attorneys authorized to practice before the federal court. He did not comply with conditions of his State Bar probation or keep his membership address current.

In mitigation, Manshardt had severe emotional difficulties and financial stress, was seriously injured in an automobile accident, was divorced, depressed, homeless and sometimes didn’t know he was suspended from practice.

PATRICK J. MANSHARDT [#178085], 43, of Los Angeles was suspended for two years, stayed, placed on two years of probation with an actual 60-day suspension and he was ordered to take the MPRE within one year. The order took effect Feb. 28, 2009.

Manshardt stipulated to four counts of misconduct. He practiced law while suspended for noncompliance with MCLE requirements in 2006. By holding himself out as eligible to practice, he made misrepresentations to the court and committed acts of moral turpitude. He also did not cooperate with the bar’s investigation. In mitigation, he has no discipline record since his 1995 admission to the bar.
