January 27, 2006 DAVID RUSSELL VALLEY [#178013], 48, of San Diego was disbarred Jan. 27, 2006, and was ordered to comply with rule 955 of the California Rules of Court. In a default proceeding, the State Bar Court found that Valley failed to comply with rule 955, as required in a 2004 disciplinary order. He did not file with the Supreme Court an affidavit attesting that he notified his clients, opposing counsel or other interested parties of his suspension from practice. Failure to comply with rule 955 is grounds for disbarment.His suspension was the result of committing acts of moral turpitude by writing checks against insufficient funds in his client trust account, commingling personal and client funds in the account and failing to cooperate with the bar’s investigation.January 2, 2005 DAVID RUSSELL VALLEY [#178013], 47, of San Diego was suspended for one year, stayed, actually suspended for six months and until the State Bar Court grants a motion to terminate the suspension and was ordered to take the MPRE and comply with rule 955. If the actual suspension exceeds two years, he must prove his rehabilitation. The order took effect Jan. 2, 2005. In a default proceeding, the State Bar Court found that Valley committed multiple acts of misconduct relating to the misuse of his client trust account. He also failed to cooperate with the bar’s investigation.He issued at least eight checks against insufficient funds in the account, seven to the Barona Casino in Lakeside. The bar court found that he commingled personal and client funds and committed an act of moral turpitude. |
