LAWRENCE HELM SMITH [#175615], 43, of San Jose was suspended for one year, stayed, placed on two years of probation with a 30-day actual suspension and was ordered to make restitution, prove his rehabilitation and take the MPRE. If the actual suspension exceeds 90 days, he must comply with rule 955. The order took effect Oct. 27, 2002.

Smith stipulated to misconduct in five matters. Four involved failing to promptly refund unearned fees.

In two cases, he did some work but was fired and did not refund advanced fees. In a private nuisance/noise abatement case, he agreed to file suit after unsuccessfully trying to solve the issue through letters. He never filed the suit and stipulated that he failed to perform legal services competently.

A county jail inmate paid Smith $2,000 to represent him regarding some medical issues, but when he was unsuccessful, the client expressed dissatisfaction and Smith decided he would not pursue the matter. A fee arbitrator ruled that Smith should return $1,125 to the client, but he did not do so.

In a child support case, Smith failed to file a motion for modification or take any steps to pursue the matter. He did not return numerous phone calls, and when the client fired him, he did not return his file or refund the $1,500 advance fee. He stipulated that he failed to respond to a client's status inquiries or return client property.

In mitigation, he has no record of discipline since his 1994 admission to the bar.
