KEITH GERMAIN JORDAN [#171267], 44, of Portland, Ore., was disbarred Jan. 9, 2011, and was ordered to comply with rule 9.20 of the California Rules of Court.

Jordan stipulated that he failed to comply with probation conditions attached to a 2007 disciplinary order by failing to file a quarterly probation report on time or make 13 restitution payments. In 2010, he was again disciplined for failing to comply with rule 9.20 by not filing the required affidavit stating that he notified his clients, opposing counsel and other relevant parties of his suspension. Failure to comply with rule 9.20 is grounds for disbarment.

In the 2007 matter, Jordan stipulated to eight counts of failing to perform legal services and admitted he failed to refund unearned fees or to keep clients informed of the status of their cases. Each of the matters involved an immigration issue. In 2010, he admitted to numerous acts of misconduct in immigration cases, and he owed more than $14,000 to four clients.

In mitigation, he cooperated with the bar’s investigation.

KEITH GERMAIN JORDAN [#171267], 44, of Portland, Ore., was suspended for three years, stayed, and placed on probation for three years with an actual suspension for a minimum of two years and until he makes restitution and provides proof of rehabilitation. He also must comply with rule 9.20. The order took effect Feb. 11, 2010.

Jordan owes $14, 650 to four clients. He took a number of immigration cases and then failed to perform the necessary work to help the clients with such issues as asylum, citizenship, visa, deportation and criminal matters. Among other things, Jordan was charged with not showing up for scheduled court appearances, allowing a non-lawyer to make ill-advised decisions for a client, refusing to return unearned fees, failing to respond to client calls or follow through on cases, failing to hire needed interpreters or file documents on time and failing to notify a client of his move out-of-state.

KEITH GERMAN JORDAN [#171267], 40, of San Jose was suspended for two years, stayed. Placed on three years of probation with a nine-month actual suspension and was ordered to take the MPRE within one year and comply with rule 9.20. The order took effect June 28, 2007.

One client, for example, paid a flat fee of $5,000 for Jordan to file an application for political asylum. Although Jordan prepared the application, he never filed it, the client’s visa expired, he lost his legal status in the U.S. and was ordered to leave the country. Jordan refunded half the fee.

In another matter, he filed an appeal late and when he tried to reopen the case, he blamed ineffective assistance of counsel — not himself, but a former attorney. However, Jordan did not file a required complain to the State Bar about the other lawyer. In several matters, Jordan did not file appeals before the required deadlines. Several clients faced deportation as a result of his actions.
