PAUL ERNEST VALLONE [#168395], 52, of Martinez, was disbarred June 18, 2016 and ordered to comply with rule 9.20 of the California Rules of Court.

Vallone was found culpable of violating rule 9.20 of the California Rules of Court.

He had two prior records of discipline. In 2011, he was suspended for five counts of misconduct in four matters, three of which involved convictions for driving under the influence of alcohol. In the fourth matter, he falsified a proposed court order in his legal separation. In 2013, his State Bar probation was revoked for violations that included not scheduling a meeting with his assigned probation deputy on time, not providing proof of having attended Alcoholics Anonymous meetings and not arranging required drug and alcohol tests.

The probation of PAUL ERNEST VALLONE [#168395], 48, of Martinez, was revoked, the previous stay of suspension was lifted, he was suspended for two years and until he shows proof of his rehabilitation, and he was ordered to comply with rule 9.20 of the California Rules of Court. The order took effect May 17, 2013.

Vallone failed to comply with the requirements of a 2011 disciplinary order by not timely scheduling a meeting with his assigned probation deputy, not providing proof of having attended Alcoholics Anonymous meetings and not arranging to have drug and alcohol tests to show he was abstaining from drugs and alcohol. Vallone also failed to abide by other terms of his probation, including providing the Office of Probation with a medical waiver.

In the underlying discipline, Vallone was found to have committed five acts of misconduct in four matters, three of which involved convictions for driving under the influence.

October 20, 2011

PAUL ERNEST VALLONE, 47, of Martinez was suspended for two years, stayed, placed on three years of probation with a 30-day actual suspension and was ordered to take the MPRE within one year. The order took effect Oct. 20, 2011.

Vallone stipulated to five counts of misconduct in four matters; three involved convictions for driving under the influence.

In the fourth matter, he falsified a proposed court order in his legal separation case and forged a judge’s signature. He sent the order to his wife in order to coerce her to return to the family home with the couple’s children. He also made false statements to the court, which held an order to show cause hearing because of the false order. His actions constituted moral turpitude.

In mitigation, Vallone has no prior discipline record, cooperated with the bar’s investigation and displayed remorse.
