Discipline Summaries

December 13, 2013

SUSAN PATRICIA WIDULE [#166530], 49, of Alameda was suspended for one year, stayed, placed on one year of probation and ordered to take the MPRE. The order took effect Dec. 13, 2013.

Widule stipulated to misconduct in one client matter. In August 2012, a woman hired her to assist in a real estate transfer and to update her will and living trust, paying her $700 in fees. From that point on Widule did no work on the case and failed to communicate with her client. After repeated attempts to get in touch with her, the client left for Canada, where she spends most of the year. In her absence, the client’s son tried to get in touch with Widule to no avail.

Widule stipulated that she failed to perform legal services with competence, promptly return unearned fees, promptly respond to a client’s reasonable status inquiries, promptly return a client file or cooperate in the disciplinary investigation.

In mitigation, Widule had no prior record of discipline and cooperated with the State Bar by entering into a pre-trial stipulation.
