April 3, 2002

THOMAS P. FREYDL [159567], 60, of Long Beach was disbarred April 3, 2002, and ordered to comply with rule 955.

A State Bar Court hearing judge had recommended that Freydl be suspended for two years for misconduct committed in Michigan. Freydl sought review, and the review department recommended that he be disbarred, finding that he has a "disturbing history" of ignoring his obligations to clients, failing to respond to disciplinary proceedings in both Michigan and California and failing to comply with provisions of a prior California discipline.

Two disciplinary actions were brought against Freydl in California, and he argued that the first bars the subsequent action. The review department rejected his arguments.

In one matter, Freydl misappropriated $12,500 from a client, failed to keep the client's funds in trust, keep the client informed about the status of her funds or account for funds. His actions constitued moral turpitude. He also did not take the necessary legal action to protect his client's interest and did not respond to her inquiries about the status of her case.

In the other matter, Freydl stipulated to borrowing $10,000 from a client on a no-interest loan and a verbal promise of repayment, without advising the client in writing of his right to seek independent legal advice. He also received $5,000 in advance fees from another client to file a copyright infringement action. He didn't file the action, and although he performed some work on the case, he failed to refund $2,500 in fees, respond to the client's reasonable inquiries or keep the State Bar advised of his current address.

In recommending Freydl's disbarment, Judge James Obrien wrote, "We find nothing in the record to warrant exemption of this matter from the Supreme Court's observation that 'misappropriation generally warrants disbarment unless clearly extenuating circumstances are present.'"

February 3, 2000

The probation of THOMAS PATRICK FREYDL [#159567], 58, of Montebello was revoked, the previous stay of suspension was lifted, and he was suspended for six months with credit for a 45-day period of actual suspension and for a period of involuntary inactive enrollment that began Nov. 7, 1999. He was ordered to comply with rule 955. The order took effect Feb. 3, 2000.

Freydl was disciplined in 1998 but failed to file quarterly probation reports, a condition of his probation.

He had stipulated to five counts of misconduct in two client matters, including failing to return unearned fees or respond to client inquiries. He also entered into a loan agreement with a client without putting the terms of the loan into writing or advising the client to seek independent counsel.

THOMAS PATRICK FREYDL [#159567], 56, of Long Beach was suspended for two years, stayed, and placed on two years of probation with an actual 45-day suspension and until he makes restitution. If the actual suspension exceeds two years, he must prove his rehabilitation. If the suspension exceeds 90 days, he must comply with rule 955. He also was ordered to take the MPRE. The order took effect June 12, 1998.

Freydl stipulated to five counts of misconduct in two client matters.

In the first, he was paid a $5,000 advance fee to represent a client in a copyright infringement action. Although he did some work on the case, he did not file the lawsuit and was fired.

The client requested a refund of the fee, less $2,500 for expenses. Freydl did not respond to letters and phone calls about the fee and he never refunded the money.

In the second case, a client made a no-interest $10,000 loan to Freydl, which he agreed to repay in seven days.

Freydl did not put the terms of the loan in writing, did not advise the client to seek independent counsel, and did not get his client's consent in writing.

Freydl did not keep his address current with the bar.

In mitigation, he has no prior discipline.
