October 11, 2013 NOBERTO F. REYES III [#158569], 54, of Los Angeles, was suspended for one year, stayed, placed on two years’ probation with an actual 90-day suspension and ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. The order took effect Oct. 11, 2013. Reyes stipulated to one count of misconduct in a single client matter: failing to keep a client informed of significant developments in a matter. In 2010, a couple hired Reyes to file a lawsuit against their mortgage lender. The following year, Reyes filed a request to dismiss the case without the couple’s knowledge. Months later, he told them the case had been dismissed but said he planned to redraft the complaint. After repeated requests for updates, an associate in Reyes’ firm sent an email to the couple notifying them that no other complaint would be filed and that they were no longer in litigation.Reyes had two prior records of discipline: a 1996 private reproval for failing to communicate a settlement offer to a client and a 2004 suspension for client trust fund violations.October 23, 2004 NORBERTO F. A check he wrote to reimburse the insurance company for medical payments was returned because the trust account was closed. In that matter, he stipulated to two counts of failing to maintain client funds in a client trust account.Reyes was privately reproved in 1996 for failing to return client phone calls.In mitigation, he cooperated with the bar’s investigation and demonstrated remorse for his wrongdoing. |
