ROBERT SHAYNE FIGGINS [#157941], 43, of Universal City was suspended for one year, stayed, placed on three years of probation with an actual 90-day suspension and he was ordered to take the MPRE within one year and comply with rule 9.20. The order took effect Sept.17, 2009.

Figgins stipulated to misconduct in 2005 prior to his acceptance into the Lawyers Assistance Program and the Alternative Discipline Program for lawyers with mental health or substance abuse issues. Because he successfully completed the ADP, a lesser degree of discipline was imposed.

He admitted misconduct in eight matters, all but one representing the same client or a subsidiary of that client. He failed to perform legal services competently or release a client file and committed acts of moral turpitude by misrepresenting the status of some litigation and settling a case without authority.

He had no prior discipline record and his mental health issues at the time directly caused the misconduct.
