April 26, 2015

RAYEHE MAZAREI [#155873], 49, of Oceanside, was suspended from the practice of law for one year and ordered to comply with rule 9.20 of the California Rules of Court. She was also placed on three years’ probation and faces a two-year suspension if she does not comply with the terms of her disciplinary probation. The order took effect April 26, 2015.

Mazarei stipulated that she did not comply with the terms of her disciplinary probation because she failed to submit three quarterly reports to probation by their due dates, failed to submit compliant quarterly reports and did not contact and meet with her assigned probation deputy within 30 days of the effective date of her discipline.

In mitigation, Mazarei entered into a pretrial stipulation with the State Bar.

She had two prior records of discipline. In 2003, she was suspended for failing to perform legal services with competence and adequately supervise her staff. In 2013, she was suspended a second time for moral turpitude. She agreed to represent a client in an immigration matter when she knew there was no way to withdraw the client’s application for naturalization and misrepresented that his application for naturalization had been withdrawn and that a Freedom of Information Act request had been submitted.

September 21, 2013

RAYEHE MAZAREI [#155873], 47, of Fountain Valley, was suspended for one year, stayed, placed on two years’ probation with an actual 30-day suspension and ordered to take the MPRE. The order took effect Sept. 21, 2013.

Mazarei stipulated to misconduct in one client matter in 2007 in which she represented a man in connection with his immigration case. Mazarei misrepresented to the client that she had withdrawn his application for naturalization in order to fix problems with it and that she had filed a Freedom of Information Act request on his behalf in 2007. The FOIA request was not submitted until 2009.

Mazarei had one prior record of discipline. In 2003, she received a six-month stayed suspension for failing to perform and inadequately supervising her staff.

August 27, 2003

RAYEHE MAZAREI [#155873], 37, of Irvine was suspended for six months, stayed, placed on one year of probation and was ordered to take the MPRE within one year. The order took effect Aug. 27, 2003.

Mazarei stipulated that she failed to provide competent legal services in an immigration matter as a result of inadequate supervision of her staff. Mazarei states she gave her clients' INS documents to a paralegal who was to file them but did not do so.

In addition, four money orders made payable to the INS were cashed through Mazarei's general bank account after they were changed to list Mazarei as the payee. They also were endorsed by someone who signed Mazarei's name. Mazarei says her paralegal made the changes and endorsed the money orders.

The paralegal also is a client, Mazarei says, and she cannot reveal his identity. As a result, the bar has been unable to verify Mazarei's claims.

Mazarei has no record of discipline, she cooperated with the bar's investigation, she made restitution and she was caring for her ill father at the time.
