Silberman stipulated to five counts of misconduct including failure to perform or keep a client informed about the status of a case, contacting an employee of a party he knew was represented by counsel, and failing to promptly return attorney's fees when ordered to do so by an administrative board.

Silberman was privately reproved in 1994 for threatening to bring criminal charges in order to gain advantage in a civil lawsuit.

In mitigation, he cooperated with the bar's investigation, handles a variety of pro bono cases, and teaches at Golden Gate and San Francisco law schools and at the University of San Francisco paralegal school.
