Discipline Summaries

June 25, 2011

SAYEH AYAZI KHOEI [#153814,] 51, of Encino was suspended for two years, stayed, placed on three years of probation with a six-month actual suspension and was ordered to take the MPRE within one year. The order took effect June 25, 2011.

Khoei successfully completed the State Bar’s Alternative Discipline Program for lawyers with substance abuse or mental problems after demonstrating a connection between her misconduct and mental health issues. She stipulated that in a consolidated matter involving seven clients, she committed 18 acts of misconduct. She failed to perform legal services competently, communicate with clients, release client files, pay out client funds, report to the bar a malpractice and breach of fiduciary duty judgment against her, or take steps to protect her client’s interests after she was terminated.

In mitigation, Khoei had no prior discipline record, cooperated with the bar’s investigation and had extreme emotional difficulties.
