JOSEPH FELIX McNULTY [#151907], 53, of North Hollywood was suspended for two years, stayed, and placed on probation for three years with an actual suspension of 60 days. The order took effect March 5, 2010.

McNulty tied his misconduct to substance abuse problems and successfully completed the Alternative Discipline Program in 2009. As part of his enrollment in the ADP and the Lawyer Assistance Program, McNulty stipulated to the misconduct.

He took on two clients in workers’ compensation and personal injury cases and then failed to show up for hearings and trial dates or to inform his clients of developments in the cases. When the State Bar initiated investigations into complaints from the clients, McNulty did not respond.

He also lost a $100,000 malpractice lawsuit in Orange County Superior Court but never paid sanctions or appeared at a hearing in which he was required to produce certain documents. He then did not cooperate with the State Bar in its investigation of the matter.

He also did not provide proof of successful passage of the MPRE, even though he had been given an extension following a private reproval in an earlier discipline.
