CHERYL JANE ERBER, 54, of Palo Alto was disbarred Sept. 15, 2012, and was ordered to make restitution and comply with rule 9.20 of the California Rules of Court.

Erber’s default was entered in 2011 after she failed to respond to disciplinary charges of three acts of misconduct in two matters. Under rule 5.85 of the bar’s Rules of Procedure, she was disbarred for failing to act within 180 days to have the default set aside. She has no prior discipline record and no claims against her have been made to the Client Security Fund.

The charges are considered proven. In one matter, she failed to perform legal services competently by not filing a complete temporary protective order or temporary restraining order on behalf of her client and she did not promptly refund any part of a $1,500 unearned fee. She also did not refund an unearned $2,000 fee in the second matter.
