JAMES A. TEEL [#150696], 55, of Irvine, was disbarred Oct. 23, 2015 and ordered to comply with rule 9.20 of the California Rules of Court.

A State Bar Court hearing judge recommended Teel receive an actual two-year suspension for failing to comply with the conditions of his probation. The Office of Chief Trial Counsel appealed the judge’s recommendation, seeking disbarment.

In concluding that Teel should lose his license to practice law, a three-judge review panel found additional aggravating evidence, writing that Teel’s “probation violations are due in large measure to Teel’s ongoing failure to successfully participate in a random drug and alcohol testing program, which is intended to monitor his sobriety following his DUI convictions.

“This is a common thread that runs through Teel’s entire disciplinary record,” the panel wrote. “We thus find the risk is high that he will continue to offend and that he is not a good candidate for probation.”

Teel failed to file an Alcoholics Anonymous attendance log with the Office of Probation by deadline, did not meet deadlines for alcohol and drug screening tests, did not ensure that all drug and alcohol screening tests were performed in a manner that maintained specimen integrity and did not maintain a current phone number where probation could contact him at all times. He also reported that he had complied with the conditions of his probation when he had not.

Teel had two prior records of discipline. In 2009, he was suspended after his conviction for eight crimes – including battery against a spouse or cohabitant, contempt of court for violating a protective order, child endangerment, assault and battery and two instances of driving under the influence. In 2011, his probation was revoked after he violated three probation conditions attached to a 2009 disciplinary order.

August 11, 2011

The probation of JAMES ALLEN TEEL [#150696], 51, of Irvine was revoked, he was given a two-year stayed suspension and a 60-day actual suspension and was placed on two years of probation. The order took effect Aug. 11, 2011.

The State Bar Court review department found that Teel violated three probation conditions attached to a 2009 disciplinary order. He filed proof of attendance at an Alcoholics Anonymous meeting one day late, did not take a drug test on time and did not provide evidence that he complied with criminal probation conditions, even though he had done so. Although there were significant extenuating circumstances, the violations were considered minor, and the review panel said he failed to comply “due to personal circumstances,” it still found Teel violated his probation.

He claimed a bar prosecutor did not have the authority to “appear as a prosecutor” in the probation revocation proceedings and argued that his probation conditions were unconstitutionally vague and overbroad. The review panel rejected his challenges.

Teel stipulated in 2009 that his eight criminal convictions constituted misconduct warranting discipline. The convictions included battery against a spouse or cohabitant, contempt of court (twice), child endangerment, assault and battery and two DUIs.

October 29, 2009

JAMES ALLEN TEEL [#150696], 49, of Irvine was suspended for two years, stayed, placed on five years of probation and was ordered to take the MPRE within one year. The order took effect Oct. 29, 2009.

Teel stipulated that he was convicted of eight crimes between 1999 and 2006 — including battery against a spouse or cohabitant; contempt of court (twice) for violating a protective order; two instances of driving under the influence; child endangerment; and assault and battery. The violations did not involve moral turpitude.
