ARTHUR GREENSPAN [#150216], 50, of Brentwood was suspended for two years, stayed, placed on three years of probation with an actual one-year suspension and he was ordered to comply with rule 9.20 of the California Rules of Court. The order took effect Jan. 2, 2013.

Greenspan stipulated that he failed to comply with probation requirements imposed as part of a 2010 disciplinary order. He did not file seven of nine quarterly and certified public accountant reports by the deadline, nor did he report that he completed restitution in a timely fashion.

The underlying discipline was imposed for failures to perform legal services competently or deposit client funds in a trust account. He also was privately reproved in 2001 after stipulating that he signed his client’s name with the client’s consent to a declaration that he filed.

In mitigation, Greenspan became the sole caretaker for his two teenage children after his ex-wife died of cancer; the family stress and added responsibilities interfered with his ability to comply with probation conditions.

ARTHUR GREENSPAN [#150216], 47, of Van Nuys was suspended for one year, stayed, placed on two years of probation with an actual 30-day suspension and was ordered to take the MPRE within one year. The order took effect Feb. 21, 2010.

Greenspan stipulated to two counts of misconduct in two matters.

In the first, he was hired by a law firm to review a criminal defendant’s trial transcripts, establish legal arguments for a petition for writ of habeas corpus and to provide investigative assistance. He did little work and admitted his investigator had “dropped the ball.” The petition was filed without any input from Greenspan, who admitted he failed to provide competent legal work.

In the second matter, Greenspan stipulated that he failed to deposit client funds in a trust account. He used part of the $5,000 that was designated for payment of an expert witness to pay a co-counsel’s costs. He had been hired to represent a criminal defendant in Oregon, where the other lawyer was admitted.

Greenspan was privately reproved in 2001 after stipulating that he signed his client’s name with the client’s consent to a declaration that he filed. He did not notify the court that he signed the document. In mitigation, his misconduct did not harm his clients.
