June 25, 2015 JEFFREY BRYAN SMITH [#150095], 51, of Long Beach, was placed on probation for one year and faces a one-year suspension if he does not comply with the terms of his disciplinary probation. He was also ordered to take the MPRE. The order took effect June 25, 2015. Smith stipulated that he failed to negotiate and resolve credit card debt on behalf of one client, did not respond to at least 15 inquiries she made to him about her matter and failed to take steps to avoid reasonably foreseeable prejudice upon constructive termination of his employment. In addition, he did not promptly return $1,500 in unearned fees, provide an accounting or cooperate with a State Bar investigator looking into the misconduct.In another matter, he failed to promptly return $10,000 in unearned fees to a client, render an accounting to the client or provide a substantive response to two letters from a State Bar investigator.In mitigation, he had no prior record of discipline and entered into a pretrial stipulation with the State Bar. |
