Discipline Summaries
January 4, 2004 BENJAMIN CASILLAS [#149096], 43, of Canby, Minn was suspended for three years, stayed, placed on three years of probation with a six-month actual suspension and was ordered to take the MPRE within one year and comply with rule 955. The order took effect Jan. 4, 2004. Casillas stipulated to misconduct in four matters, all the result of his failure to supervise his girlfriend/employee and limit her access to his office operations. The girlfriend was a friend of each of the clients involved prior to their legal matters; Casillas did not know any of them. In each matter, the girlfriend engaged in misconduct unbeknownst to Casillas, and repeatedly lied to and misled Casillas and the clients about the cases. In 1998, Casillas made plans to attend medical school, and although he advised his girlfriend he would not accept any more cases, she accepted two cases on his behalf without his knowledge. Any work done on those cases was done by the girlfriend.In mitigation, Casillas has no record of discipline. |
