DANIEL E. KRITZ [#148714], 50, of Richmond, was disbarred Aug. 16, 2013 and ordered to comply with Rule 9.20 of the California Rules of Court.

Kritz stipulated to failing to comply with the terms of his disciplinary probation outlined in a 2010 disciplinary order. The State Bar Court approved the stipulation but the California Supreme Court returned the matter for reconsideration as to the level of discipline.

Kritz failed to meet deadlines for filing three reports with probation, failed to take the MPRE and to file his rule 9.20 affidavit on time. He also stipulated to facts surrounding a criminal matter filed in Marin County Superior Court.

Kritz has two prior records of discipline. In 2008, he received a public reproval for failing to promptly release a client’s file, to attend criminal court hearings or take any action on behalf of his clients. In 2010, he stipulated to violating conditions of the earlier private reproval.

DANIEL EUGENE KRITZ [#148714], 47, of Richmond was suspended for two years, stayed, placed on two years of probation with a 90-day actual suspension and he was ordered to take the MPRE within one year and comply with rule 9.20 of the California Rules of Court. The order took effect Oct. 15, 2010.

Kritz violated conditions attached to a 2008 public reproval – he did not meet with the probation office, attend ethics school, pass the MPRE or file the required quarterly reports. The reproval was imposed for failing to perform legal services competently or return client files.
