ROGER ALLEN MOORE [#146375], 53, of Stockton was suspended for one year, stayed, placed on two years’ probation with an actual 30-day suspension and ordered to take the MPRE. The order took effect March 29, 2014.

Moore stipulated to misconduct in one client matter: committing an act involving moral turpitude and failing to perform legal services with competence, keep all agreements made in lieu of disciplinary prosecution or cooperate or participate in a State Bar investigation.

In 2008, Moore was hired to represent a woman in her slip-and-fall case but did not file the lawsuit until after the statute of limitations expired. After the client made a complaint, Moore erroneously told the State Bar that he had malpractice insurance at the time he represented the woman. In fact, his coverage had lapsed. In 2012, he entered into an agreement in lieu of discipline with the State Bar that required him to comply with a number of conditions including that he send a letter to the client listing his insurance policy number and carrier and provide proof of sending the letter and his coverage to the State Bar. Moore sent the client a letter after the required deadline stating that his policy had expired. He did not respond to a subsequent letter from a State Bar investigator.

In mitigation, Moore had no prior record of discipline, took remedial steps following his misconduct and cooperated with the State Bar by entering into a pretrial stipulation.
