April 23, 2000

EDWARD DEANE DONOVAN [#145981], 43, of West Hills was disbarred April 23, 2000, and was ordered to comply with rule 955.

Donovan violated a 1998 disciplinary requirement ordering that he comply with rule 955.

He has a record of three prior disciplines; his default was entered in each.

In 1995, he was suspended following a third DUI conviction. The following year, the bar court found that he failed to return a client’s file.

The third discipline was the result of Donovan’s failure to file quarterly probation reports.

July 8, 1998

EDWARD DEANE DONOVAN [#145981], 41, of West Hills was suspended for two years, stayed, placed on two years of probation with a one-year actual suspension and until he proves his rehabilitation, and was ordered to comply with rule 955. The order took effect July 8, 1998.

Donovan was disciplined because he failed to submit six quarterly probation reports, as required in a prior discipline.

He was first suspended and placed on probation in 1995 following criminal convictions for driving under the influence, driving with a blood alcohol of .08 percent or more, and disorderly conduct while under the influence of alcohol.

The following year, he was again suspended and given additional probation for failing to promptly release client files in a case which was dismissed when the statute of limitations ran.

In addition to not filing probation reports, Donovan failed to provide proof of enrollment in a substance abuse program, attendance at thrice-weekly Alcoholics Anonymous meetings, or a lab screening report showing abstinence from drugs and alcohol.

Donovan did not participate in the proceedings, and his default was entered.

There were no mitigating factors. Although Donovan sent a letter and purported late probation reports after his default was entered, they were not allowed into evidence because he did not move to vacate the default. In addition, the reports were incomplete because they provided no proof of lab tests or attendance at AA meetings.

Calling the reports “self-serving” and lacking in trustworthiness, the hearing judge wrote, “The court is left without any assurances that respondent is in control of his addiction.”

November 17, 1996

EDWARD DEANNE DONOVAN [#145981], 39, of Malibu was suspended for one year, stayed, and placed on probation for two years, with 90 days actual suspension, effective Nov. 17, 1996. He was ordered to comply with rule 955.

Donovan failed to release case records requested by a client involved in a police brutality lawsuit.

In its decision, the hearing department of the State Bar Court considered Donovan's prior record of discipline an aggravating factor.

In 1995, Donovan received a 45-day actual suspension, one year stayed suspension and two years of probation following three alcohol-related criminal convictions.

His failure to participate in the current discipline proceedings prior to entry of default also was considered an aggravating factor.

Since Donovan did not participate in the proceedings, no evidence of mitigation was presented.

November 24, 1995

EDWARD DEANE DONOVAN [#145981], 38, of Corona Del Mar was suspended for one year, stayed, placed on two years probation with an actual 45-day suspension and was ordered to pass the CPRE within one year. The order took effect Nov. 24, 1995.

Donovan was convicted in 1993 of driving under the influence with a prior conviction and refusing to submit to an alcohol test.

The following year, he pleaded guilty to driving under the influence, driving without a license and having two priors. He also pleaded guilty in a separate case to disorderly behavior while intoxicated.

In a default hearing, the bar court determined Donovan's conduct did not involve moral turpitude but did warrant discipline.

Donovan also was suspended last August for failing to pay bar dues and was placed on administrative inactive status for not completing his MCLE requirements.
