November 30, 2007

PHILIP JOSEPH GIRARDIN [#142664], 61, of Glendale was ordered to comply with new probation conditions and rule 9.20, effective Nov. 30, 2007.

Girardin’s probation was revoked in 2006 after he failed to comply with probation conditions attached to an earlier discipline. The order omitted two conditions — a requirement that he meet with the bar’s probation office and that he provide the results of monthly lab tests to prove his abstinence from alcohol and/or drugs.

The original discipline was imposed as a result of Girardin’s 1998 no contest plea to two felony counts of driving under the influence. He had six prior DUI convictions and was sentenced to two years in state prison.

July 2, 2006

PHILIP J. GIRARDIN [#142664], 60, of Glendale Probation was revoked, the previous stay of suspension was lifted and he was actually suspended for 90 days. The order took effect July 2, 2006.

Girardin stipulated that he failed to file numerous quarterly probation reports or proof of attendance at Alcoholics Anonymous meetings, and he did not keep his address current with the State Bar.

He was placed on interim suspension in 1999 following a conviction for driving under the influence with a prior. He subsequently was suspended and placed on probation, and in 2002 was suspended again for failing to meet the conditions of his probation.

In mitigation, Girardin was hospitalized earlier this year for treatment of a kidney disorder and depression.

February 7, 2002

PHILIP JOSEPH GIRARDIN [142664], 56, of Glendale - Girardin's previously ordered suspension and probation was extended due to his failure to comply with the terms and conditions of his probation. The period of Girardin's stayed suspension was extended by six months to two-and-a half years, and the probation period was extended by one year to six years. The order took effect on Feb. 7, 2002.

Girardin stipulated that he failed to submit quarterly reports and statements of compliance with probation conditions in a timely fashion, instead supplying such reports several months after they were due. Girardin also failed to timely supply proof of attendance at Alcoholics Anonymous or The Other Bar meetings as required by the 1999 stipulation, and for certain months supplied no proof at all.

In mitigation, Girardin supplied evidence that severe financial stress and emotional and physical difficulties associated with his recovery from alcohol addiction were factors directly responsible for the misconduct.

May 19, 2000

PHILIP JOSEPH GIRARDIN [#142664], 54, of Glendale was suspended for two years, stayed, placed on five years of probation with a six-month actual suspension, and was ordered to prove his rehabilitation and take the MPRE within one year. Credit towards the actual suspension will be given for the period of interim suspension which began May 16, 1999. The order took effect May 19, 2000.

In 1998, Girardin pleaded no contest to two felony counts of driving under the influence and was sentenced to two years in state prison. He had six prior DUI convictions.

He stipulated that his actions constituted misconduct warranting discipline because his behavior showed a lack of respect for the legal system as well as an alcohol abuse problem. Both problems, if not checked, could spill over into his practice and adversely affect his representation of clients, according to the stipulation.

In mitigation, Girardin has been sober for two years and attends daily AA meetings. He cooperated with the bar’s disciplinary proceedings.
