CHARLES JEFFREY FLETCHER [#142464], 56, of Sacramento, was placed on two years’ probation and faces a one-year suspension if he does not comply with the terms of his disciplinary probation. He was also ordered to take the MPRE. The order took effect March 18, 2016.

Fletcher’s discipline stems from three client matters. In one, he failed to perform legal services with competence by not filing a writ of habeas corpus and not working with appellate counsel, accepted compensation from someone other than his client without getting his client’s consent, failed to provide an accounting and did not fully refund unearned fees. He also accepted compensation from someone other than his client without getting his client’s consent in two other matters. In one of those matters he did not refund unearned fees for almost two years.

In mitigation, he had no prior record of discipline in many years of practicing law, presented evidence of his good character and entered into a pretrial stipulation with the State Bar.
