February 21, 2015 SHAWN MICHAEL MCSHANE [#141236], 55, of Los Angeles, was suspended from the practice of law for one year and ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. He was also placed on two years’ probation and faces a two-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect Feb. 21, 2015. McShane was suspended as the result of his plea of no contest in 2010 to one count of driving under the influence and causing injury. On Oct. 25, 2009, he ran a red light and hit a vehicle driven by an 82-year-old woman who suffered fractured ribs and a collapsed lung. He left the accident scene, got onto the freeway and eventually crashed his car into the center divider. He was taken to the hospital and tested positive for Soma, a pain medication, and Meprobamate, an anti-anxiety medication. At the time of his arrest, he was on probation for a 2006 conviction for DUI. He also had a misdemeanor DUI conviction in 2000. In mitigation, McShane had no prior record of discipline, entered into a pretrial stipulation with the State Bar and was suffering from emotional/physical problems at the time of his misconduct. |
