TIMOTHY CLARENCE BRYSON [#140798], 61, of San Diego was disbarred May 10, 2013, and was ordered to comply with rule 9.20 of the California Rules of Court and to make restitution.

Bryson’s default was entered after he failed to respond to charges of misconduct in a matter involving four clients. Because he did not attempt to have the default vacated within 180 days, the charges were deemed admitted as required by rule 5.85 of the State Bar’s Rules of Procedure. Bryson was found culpable of accepting an advanced fee and failing to provide adequate notification in a loan modification matter, failing to deposit and maintain funds in trust, improperly withdrawing disputed funds from trust, failing to promptly disperse or return client funds, failing to account, failing to cooperate in a disciplinary investigation, failing to perform legal services with competence, charging an illegal fee and misappropriation. He was ordered to pay $13,320 in restitution, plus interest.

Bryson was disciplined on three prior occasions, for failing to comply with the conditions of his probation, failing to perform legal services competently, respond to client inquiries or maintain a current address and phone number with the bar and failing to adequately supervise a paralegal.

TIMOTHY CLARENCE BRYSON, 60, of San Diego was suspended for two years, stayed, placed on three years of probation with an actual 120-day suspension and he was ordered to comply with rule 9.20 of the California Rules of Court. The order took effect June 21, 2012.

Bryson failed to comply with probation conditions attached to a 2011 disciplinary order. He did not contact the probation office until nearly six months after the deadline or file quarterly probation reports on time.

The underlying discipline was imposed for misconduct in a probate matter. Bryson also was disciplined in 2001 for failing to adequately supervise a paralegal.

In mitigation, he cooperated with the bar’s investigation, his father died and his office was flooded, and he says he did not receive all his mail at his new location.

February 18, 2011

TIMOTHY CLARENCE BRYSON [#140798], 59, of San Diego was suspended for one year, stayed, placed on two years of probation and was ordered to take the MPRE within one year. The order took effect Feb. 18, 2011.

Bryson stipulated to three counts of misconduct in a probate matter in which he filed a guardianship petition for his clients. He did not correct defects in the petition, as ordered by a probate examiner, nor did he appear at a hearing and the case was taken off the calendar. Bryson did not respond to the clients’ many phone calls over the next nine months.

He had assigned a paralegal to work on the matter, under his supervision. When the paralegal left his employ, Bryson reviewed the file and learned the necessary work had not been done. With the help of a new paralegal, Bryson filed a new petition that was granted – almost three years after he was hired.

An investigator was unable to find Bryson after his clients complained because he did not keep his address current with the State Bar.

He stipulated that he failed to perform legal services competently, respond to client inquiries or maintain a current address and phone number with the bar.

Bryson was suspended in 2001 for failing to adequately supervise a paralegal. In mitigation, he cooperated with the bar’s investigation and he took steps to complete the guardianship as soon as he learned his paralegal had not performed the requisite work.

November 23, 2001

TIMOTHY C. BRYSON [#140798], 50, of San Diego was suspended for 30 days, stayed, placed on one year of probation and was ordered to take the MPRE within one year. The order took effect Nov. 23, 2001.

Bryson stipulated that he failed to perform legal services competently for a client who hired him to represent her in immigration proceedings. He did not review his client’s application to adjust her immigration status or supervise his staff, including a woman who obtained a work permit for the client to which she was not entitled.

The client was deported.

In mitigation, Bryson had significant personal and family problems, including serious medical and psychiatric problems of his wife and children, which affected his ability to practice.

He has no record of discipline and he cooperated with the bar’s investigation.
