RICHARD LYNN BARRETT [#140747], 51, of Riverside was suspended for three years, stayed, placed on three years of probation with a six-month actual suspension and he was ordered to take the MPRE within one year and comply with rule 9.20 of the California Rules of Court. The order took effect May 2, 2011.

Barrett successfully completed the Alternative Discipline Program after demonstrating a connection between his misconduct and his mental health issue.

He stipulated to misconduct in two sets of disciplinary charges. In the first, he admitted he failed to perform legal services with competence, promptly respond to reasonable status inquiries, refund an unearned fee, comply with the conditions of a public reproval or cooperate with the bar’s investigation and he made a misrepresentation to his client.

In a second matter, he stipulated to four counts of failing to perform legal services with competence, three counts of failing to promptly respond to client status inquiries, one count each of failing to refund an unearned fee and release a client file, and four counts of failing to cooperate with the bar’s investigation. He also improperly withdrew from representation three times.
