September 9, 2011

BRYANT KEITH CALLOWAY [#140431], 49, of Foothill Ranch was disbarred Sept. 9, 2011, and was ordered to comply with rule 9.20 of the California Rules of Court.

The State Bar Court found that Calloway violated rule 9.20 by failing to submit an affidavit to the court stating that he notified his clients, opposing counsel and other pertinent parties of his suspension. He also failed to comply with probation conditions by submitting three quarterly probation reports late.

Although he was seriously ill, suffering from congestive heart failure, the court said Calloway had not said he was unable to provide the quarterly reports.

He has been disciplined four times previously, beginning with a public reproval in 1998 for failing to perform legal services competently or communicate with clients. He also was suspended in 2000, 2006 and 2009. In mitigation, he entered into an extensive stipulation and provided evidence of community involvement.

Noting that violating rule 9.20 alone is grounds for disbarment, Judge Donald Miles also pointed out Calloway’s lengthy disciplinary history and his “continued pattern of failing to comply with disciplinary orders.”

BRYANT KEITH CALLOWAY [#140431], 48, of Foothill Ranch was suspended for three years, stayed, placed on three years of probation with an actual two-year suspension and until he proves his rehabilitation, and he was ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. The order took effect Jan. 14, 2010.

Calloway did not comply with probation conditions attached to a 2006 disciplinary order either by not filing quarterly reports or filing them late, and by failing to file any evidence of having completed four hours of MCLE.

He has been disciplined three times previously: a 1998 private reproval for failing to perform legal services competently, a 2000 suspension for failing to comply with conditions attached to the reproval, and a 2006 suspension for again failing to comply with probation conditions, pay court-ordered sanctions or cooperate with the bar’s investigation.

In mitigation, he presented evidence of good character and community service and he suffered from extreme financial hardship.

February 19, 2006

BRYANT K. CALLOWAY [#140431], 44, of Mission Viejo was suspended for two years, stayed, placed on two years of probation and was ordered to take the MPRE within one year. The order took effect Feb. 19, 2006.

Calloway stipulated to misconduct in two matters.

He did not pay a $1,000 court-ordered sanction on time, and he did not cooperate with the bar’s investigation of a complaint by a client.

Calloway was previously disciplined with a private reproval in 1998 and an order to make restitution amounting to $12,500. He also received a one-year stayed suspension and was placed on two years of probation in 2000. He was required to pay $8,500 in restitution in that matter, which was the result of his failure to comply with the conditions of the private reproval.

June 21, 2000

BRYANT K. CALLOWAY [#140431], 38, of Irvine was suspended for one year, stayed, placed on two years of probation, and was ordered to make restitution and demonstrate his rehabilitation. The order took effect June 21, 2000.

Calloway stipulated that he did not comply with the conditions of a 1998 private reproval. He did not submit three quarterly probation reports or submit proof of passing the MPRE on time. He has since passed the exam.

The reproval was the result of failing to keep a client informed about significant developments in a case and failing to perform legal services competently.

In mitigation, he cooperated with the bar and he experienced family problems.
