May 28, 2016 ANTHONY ROBERT LOPEZ JR. [#137401], 55, of Woodland Hills, was suspended from the practice of law for 30 days and ordered to take the MPRE. He was also placed on one year of probation and faces a one-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect May 28, 2016. A State Bar Court hearing judge initially recommended Lopez receive two years of actual suspension and that his reinstatement be conditioned on proof of his rehabilitation. Lopez appealed the judge’s recommendation. A three-judge review panel recommended lighter discipline, concluding that the trial judge erred in finding a trust account violation but affirming the judge’s determinations as to the remaining four counts.Lopez’s suspension stemmed from his handling of a personal injury matter in which he represented two brothers, David and Miguel, who were injured in an automobile accident. When the brothers retained him to pursue personal injury claims in 2007, he knew that David, the driver, did not have a license or insurance when he rear-ended another vehicle. Even so, he did not warn them of actual or potential conflicts of interest or obtain their informed written consent to joint representation.Late that summer Lopez received a police report which indicated that David had caused the accident by speeding, and medical records that showed he had been under the influence of drugs at the time of the accident. Although he warned them of the risks related to their joint representation, he did not obtain written conflicts waivers from the brothers. He ultimately settled the brothers’ claims against the driver of the other car.In mitigation, Lopez entered into a pretrial stipulation with the State Bar, demonstrated remorse and recognition of his wrongdoing, presented strong evidence demonstrating his good character and has done pro bono work.He had two prior records of discipline. In May 2004, he was suspended for misconduct in Arizona that included failing to maintain client trust funds and trust accounting records.In July 2010, he was suspended again for 10 counts of misconduct in seven client matters including failing to properly disburse funds to clients and lienholders, obtain required court approvals for representing minors, communicate significant developments, inform a client of a written settlement offer or perform competently.January 14, 2010 ANTHONY ROBERT LOPEZ JR. [#137401], 49, of Woodland Hills was suspended for one year, stayed, placed on one year of probation with a 90-day actual suspension and he was ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. The order took effect Jan. 14, 2010. Lopez stipulated to 11 acts of misconduct in seven personal injury contingency cases and he ran a misleading radio advertisement in Nevada that led the public to believe any personal injury action is worth at least $15,000.He settled two cases involving minors without obtaining the probate court’s approval and he didn’t obtain an order directing payment of his fees. He did not communicate the terms of settlements with other clients and delayed payment of medical liens. In one matter, he didn’t file a complaint for 10 months after his client received a collection notice from her doctor.Lopez was suspended in 2004 for mishandling a client trust account he held in Arizona.May 23, 2004 ANTHONY ROBERT LOPEZ JR. [#137401], 43, of Van Nuys was suspended for one year, stayed, placed on one year of probation and was ordered to take the MPRE within one year. The order took effect May 23, 2004. Lopez was censured and placed on two years of probation in Arizona last year for mishandling his client trust account. He allowed the balance in the account to fall below the required amount, he did not maintain proper records or reconcile the account on a monthly basis.He stipulated that had the misconduct occurred in California, he would be subject to discipline here.In mitigation, he has no prior record of discipline, no clients were harmed, he cooperated with the bar’s investigation and he demonstrated remorse.Lopez has stopped practicing in Arizona and closed his law office there. |
