JAMES S. PARTRIDGE [#136207], 53, of Castro Valley, was disbarred Sept. 6, 2013 and ordered to comply with rule 9.20 of the California Rules of Court.

Partridge was disbarred after his default was entered when he failed to respond to the notice of disciplinary charges filed against him. Because he made no effort to have the default vacated within 180 days, as required by rule 5.85 of the California Rules of Procedure, Partridge was disbarred and the charges were deemed admitted.

Partridge violated rule 9.20 by not filing a declaration of compliance, a requirement of a 2011 disciplinary order. He has four prior records of discipline. In 2011, he was suspended for failing to comply with the conditions of a 2010 disciplinary order, which also stemmed from probation violations. In 2009, Partridge was suspended for violating the terms of a 2006 public reproval for improperly withdrawing from representation.

JAMES SYME PARTRIDGE, 53, of Castro Valley was suspended for three years, stayed, placed on four years of probation with a two-year actual suspension and until he proves his rehabilitation, and he was ordered to comply with rule 9.20 of the California Rules of Court. The order took effect Oct. 28, 2011.

Partridge stipulated that he failed to comply with probation conditions attached to a 2010 disciplinary order. He violated rule 9.20 by failing to submit to the State Bar Court a declaration that he notified his clients, opposing counsel and other interested parties of his suspension. He also did not submit two quarterly probation reports or meet with his assigned probation officer within 30 days.

Partridge has a record of three prior disciplines - a 2006 public reproval and suspensions in 2009 and 2010. The reproval was imposed for improperly withdrawing from representation and subsequent disciplines were imposed for probation violations.

In mitigation, he cooperated with the bar’s investigation.

JAMES SYME PARTRIDGE [#136207], 52, of Castro Valley was suspended for one year, stayed, and placed on one year of probation with a 30-day actual suspension and until he meets requirements for reinstatement imposed in another case. If the actual suspension exceeds 90 days, he must comply with rule 9.20 of the California Rules of Court and if it exceeds two years, he must prove his rehabilitation. The order took effect July 25, 2010.

Partridge did not comply with a rule 9.20 requirement imposed as part of a 2009 disciplinary order. His affidavit attesting that he notified his clients, opposing counsel and other pertinent parties of his suspension from practice was filed late.

In the underlying discipline, the result of a default proceeding, the State Bar Court found that Partridge violated the terms of a public reproval issued in 2006 after he stipulated that he improperly withdrew from representation. He did not contact his probation monitor, submit seven quarterly reports, attend ethics school or provide proof that he paid a $3,500 court sanction.

If the suspension exceeds two years, he must prove his rehabilitation. The order took effect Sept. 25, 2009.
