October 23, 2015 LORRAINE ROSENFELD [#133620], 58, of Oceanside, was disbarred Oct. 23, 2015 and ordered to comply with rule 9.20 of the California Rules of Court and pay restitution. Rosenfeld failed to respond to a notice of disciplinary charges for five counts of misconduct in a single client matter and her default was entered. Because she made no effort to have the default set aside or vacated within 90 days, as required by rule 5.85 of the State Bar’s Rules of Procedure, she was disbarred and the charges deemed admitted.Rosenfeld failed to perform by not pursuing an unlawful detainer action and failing to file and pursue a civil suit to recover unpaid rent. She improperly withdrew from employment and failed to respond to numerous client status inquiries, refund unearned fees or cooperate with the State Bar investigation.She was ordered to pay $680 plus interest in restitution. Rosenfeld had been disciplined on four prior occasions. In 1996, she was suspended for failing to comply with the terms of her disciplinary probation. In 1995, she was suspended for appearing as an attorney without authority and failing to respond to client inquiries, communicate a settlement offer, return a client file or competently perform legal services.She was suspended again in 1994 for failing to competently perform legal services, respond to client inquires or communicate significant developments. In aggravation, Rosenfeld has a prior record of discipline. She received a one-year stayed suspension in 1993 and again in 1994, with probation to run concurrently. In mitigation, she was candid and cooperated with the bar's investigation, providing all documents and information requested. Her current misconduct occurred at the same time as the two previous instances of misconduct. Rosenfeld has been a member of the bar since 1988. |
