DAVID ANDREW MANS [#133052], 52, of Pasadena, was suspended for one year, stayed, placed on two years’ probation with an actual 60-day suspension and ordered to take the MPRE. The order took effect Oct. 11, 2013.

Mans stipulated that he failed to perform legal services with competence and to maintain client funds in a client trust account. The discipline stems from his work on behalf of a client whose home was damaged along with a neighbor’s when a slope failed during a severe rainstorm. In 2008, a partial settlement was reached with the homeowners’ insurance carrier for $101,000. Although the settlement required that the funds only be used to pay for the slope repairs, Mans used $45,807.50 of the money to cover his attorney fees and paralegal costs. As a result, the contractor who repaired the hillside did not get fully compensated and sued Mans’ client.

In mitigation, Mans had no prior record of discipline.
