DOUGLAS WILLIAM DAVIS [#132620], 53, of Malibu was disbarred May 10, 2013, and was ordered to comply with rule 9.20 of the California Rules of Court.

Davis failed to meet the requirements of a 2010 disciplinary order that required he pay restitution and file quarterly reports to probation. Davis failed to file complete quarterly reports on three occasions and did not provide proof of having made $1,000 monthly payments toward restitution with three quarterly reports.

Davis was previously suspended for two years, stayed, and placed on three years of probation for failing to comply with the terms of a 2006 disciplinary order by not timely filing quarterly reports with probation and not making full restitution payments. In the underlying discipline, he was suspended for committing four acts of misconduct while representing a client in a breach of contract and discrimination case.

April 10, 2010

DOUGLAS WILLIAM DAVIS [#132620], 51, of Malibu was suspended for two years, stayed, placed on three years of probation and was ordered to take the MPRE within one year. The order took effect April 10, 2010.

Davis did not comply with the terms of a 2006 disciplinary order: he filed four quarterly reports late and he did not make full restitution payments.

In the underlying discipline, Davis was suspended for committing four acts of misconduct while representing a client in a breach of contract and discrimination action against a former employer. He also was privately reproved in 2003 for abandoning a client and not returning phone calls.

In mitigation, no clients were harmed, Davis cooperated with the bar’s investigation and he made an initial payment on the interest he owes to a physician.

DOUGLAS WILLIAM DAVIS [#132620], 46, of Malibu was suspended for two years, stayed, placed on three years of probation and was ordered to make restitution and prove his rehabilitation. The order took effect March 12, 2006.

Davis stipulated to four counts of misconduct committed during his representation of a client in a breach of contract and discrimination action against a former employer. Although he originally asked for arbitration, he did not want to comply with the employer’s arbitration rules and eventually tried to avoid arbitration. The court ordered the case to arbitration four times. Because Davis never complied, the case was dismissed and he and his client were sanctioned $70,650.99.

Davis never paid the sanctions or reported them to the bar, as required. He also did not inform his client about the sanctions.

Davis stipulated that he disobeyed court orders, failed to pay or report sanctions and did not inform his client of a significant development in his case.

He was privately reproved in 2003 for failing to perform legal services competently or communicate with a client.
