July 24, 2013 ANDREW H. LUND [#130209], 54, of Beaver Dam, Wis., was disbarred July 24, 2013 and was ordered to comply with rule 9.20 of the California Rules of Court and to pay restitution. Lund stipulated to misconduct in 11 client matters, all of which involved failure to return unearned fees. He was also found culpable of failing to take steps to avoid foreseeable prejudice to his clients, seeking to mislead a judge, failing to render appropriate accounts to a client and failing to release client files. In many of the cases, clients were left without representation after Lund suddenly closed his law practice in May 2012. He was ordered to pay $31,980.33 plus interest in restitution.Lund has three prior disciplines. In 1998, he received a private reproval for commingling funds in his client trust account. In the second discipline, he stipulated to failing to comply with the terms of the 1998 reproval, failing to perform legal services competently, obey a court order and failing to maintain the respect due to the courts. He was also suspended in 2010 for misconduct in seven matters: for failures to perform legal services with competence, to refund unearned fees, to promptly return client files, to communicate with clients or to protect client interests when his employment was terminated. He also disobeyed court orders.September 24, 2010 ANDREW HENRY LUND [#130209], 51, of Riverside was suspended for four years, stayed, placed on three years of probation with a 60-day actual suspension and he was ordered to take the MPRE within one year. The order took effect Sept. 24, 2010, although the actual suspension was not effective until Nov. 1. Lund successfully completed the State Bar’s Alternative Discipline Program, after establishing a connection between his substance abuse and his misconduct.In seven matters, Lund stipulated that he failed to perform legal services with competence, refund unearned fees, promptly return client files, communicate with clients or protect client interests when his employment was terminated. He also disobeyed court orders.He has been disciplined twice previously.December 8, 2000 ANDREW H. LUND [#130209], 41, of Long Beach was suspended for one year, stayed, placed on two years of probation with a 90-day actual suspension, and was ordered to take the MPRE within one year and comply with rule 955. The order took effect Dec. 8, 2000. Lund stipulated to misconduct in two matters.The first was a failure to comply with the conditions of a 1998 private reproval; he submitted four quarterly probation reports late and failed to submit one at all, and he failed to complete four hours of class in law practice management or pass the professional responsibility exam.In the second matter, Lund was found guilty of contempt of court and sentenced to five days in jail after a mistrial was declared because he twice failed to appear at a trial. He stipulated that he failed to perform legal services competently, obey a court order and maintain the respect due to the courts.In mitigation, Lund suffered emotional or physical disabilities at the time of the misconduct. |
