April 17, 2011 DANIEL MARTORELLA [#128700], 51, of Palm Springs was suspended for three years, stayed, placed on five years of probation with a five-month actual suspension and he was ordered to take the MPRE within one year and comply with rule 9.20 of the California Rules of Court. The order took effect April 17, 2011. Martorella successfully completed the State Bar’s Alternative Discipline Program for lawyers with mental health or substance abuse programs, after he demonstrated a connection between his misconduct and his mental health issues. He stipulated to misconduct in two cases, including failures to promptly pay out client funds, maintain client funds in a trust account or keep records of those funds, and he misappropriated at least $6,666.66 in settlement funds and wrote checks against insufficient funds, committing acts of moral turpitude. In mitigation, he has no record of discipline since his 1987 admission to the bar. |
