CARTER A. BEAVERS [#125295], 39, of Oakland was suspended for two years, stayed, and placed on probation for three years, with 15 days actual suspension, effective Nov. 17, 1996. He was ordered to pass the MPRE.

Beavers was disciplined for recklessly failing to maintain proper trust accounting practices, respond to clients' reasonable case status inquiries, release files to clients and perform legal services competently.

In the client trust account matter, Beavers' law practice disorganization and his failure to maintain proper accounting procedures resulted in his bouncing approximately 25 checks.

During this time, Beavers handled a large number of Chapter 7 and Chapter 11 bankruptcy matters and on occasion advanced his clients' costs for filing fees from his client trust account.

At other times he permitted his clients to pay for his services on an installment basis. Problems arose when client reimbursement checks bounced or clients failed to make their payments.

Although Beavers was aware of his trust account problems, he was unaware of the ethical implications and failed to remedy the situation until the State Bar apprised him of the violations. No client funds were jeopardized.

In mitigation, Beavers has practiced law since 1986 with no prior record of discipline.
