May 14, 2005

CHARLES M. MARX [#124630], 44, of San Francisco was disbarred May 14, 2005, and was ordered to comply with rule 955.

In a default proceeding, the State Bar Court determined that Marx did not meet the requirements of a 2004 disciplinary order that he comply with rule 955: he did not submit to the Supreme Court an affidavit stating that he notified his clients, opposing counsel and other interested parties of his suspension from practice.

Marx originally was disciplined in 2000 when he stipulated that he withdrew from representation of four clients without protecting their interests, failed to communicate with clients and ignored court orders over a 15-month period.

In 2002, he was disciplined for failing to comply with probation conditions, and in 2004 the probation was probation revoked.

January 11, 2004

CHARLES MacNISH MARX [124630], 43, of San Francisco -Probation was revoked, the previous stay of suspension was lifted and he was actually suspended for one year and was ordered to comply with rule 955. Credit shall be given for the period of inactive enrollment that began Sept. 27, 2003. The order took effect Jan. 11, 2004.

Marx did not file three quarterly probation reports or provide proof that he attended ethics school, as required by a 2002 discipline order.

The underlying discipline also was a probation revocation of a 2000 discipline, imposed for failing to communicate with clients or pay court-ordered sanctions and for improperly withdrawing from employment.

Marx did not participate in the proceedings.

October 4, 2002

CHARLES MacNISH MARX [#124630], 42, of San Carlos was suspended for one year, stayed, placed on two years of probation and was ordered to prove his rehabilitation. The order took effect Oct. 4, 2002.

MacNish was disciplined in 2000 but failed to comply with probation conditions: he did not file two quarterly probation reports, submit an office management plan or attend ethics school. The discipline was imposed because MacNish failed to properly withdraw from representation or communicate with a client and he disobeyed a court order.

In mitigation, MacNish cooperated with the bar's investigation and was under severe financial stress at the time of the misconduct. He voluntarily closed his law practice in September 2001 and has not practiced since then.

August 26, 2000

CHARLES M. MARX [#124630], 40, of San Carlos was suspended for one year, stayed, placed on two years of probation with a 30-day actual suspension, and was ordered to take the MPRE within one year. The order took effect Aug. 26, 2000.

Marx was disbarred from the federal district court’s eastern district in 1999 for abandoning a client. The court also found that he did not appear at a disciplinary hearing before the court, “repeatedly flouted the orders of the court,” and failed to appear when ordered to do so.

He stipulated that he withdrew from representation of four clients without protecting their interests, failed to communicate with clients and ignored court orders over a 15-month period.

In mitigation, Marx has no record of discipline since his 1986 admission to the bar, he cooperated with the bar’s investigation, he was experiencing marital difficulties at the time and he had physical problems which resulted from a bicycle accident but which went partially untreated because he had no health insurance.
