January 19, 2008 HOWARD BERNARD ZISBLATT [#122138], 50, of Los Angeles was suspended for two years, stayed, placed on two years of probation and was ordered to take the MPRE within one year and prove his rehabilitation. The order took effect Jan. 19, 2008. Zisblatt employed an individual for three years and was required to withhold funds for Social Security, Medicare and federal income taxes as well as California disability taxes. He filed three W-2 forms indicating that he withheld those funds from his employee’s earnings, but in fact he did not pay those taxes. He violated the Internal Revenue Code and the state Unemployment Insurance Code.In mitigation, Zisblatt cooperated with the bar’s investigation, provided references attesting to his good conduct and he paid the payroll tax returns plus an additional amount to cover penalties. |
