January 10, 2003 SUSAN RANDI BORG [#121337], 44, of San Mateo was suspended for one year, stayed, placed on 18 months of probation and was ordered to take the MPRE within one year. The order took effect Jan. 10, 2003. Due to a clerical error, Borg missed the deadline to file her client's appeal of the Social Security Administration's denial of his disability claim. She told the client to contact SSA directly, saying the agency would be more sympathetic to him and was more likely to grant an extension.A week later, however, she sent a letter to the SSA stating that her failure to file the appeal on time was due to the client's failure to timely obtain representation. She included two documents signed by her and the client, but she altered the dates to reflect a hiring date three months later than the true date.The client fired Borg, hired a new attorney and won an extension and a reversal of the denial of his claim.Borg stipulated that she gave a false written statement about a material fact.In mitigation, she has no discipline in 15 years of practice, she cooperated with the bar's investigation and she expressed remorse. |
