JOHN ROBERT DeLORETO [#118885], 48, of Santa Barbara was suspended for one year, stayed, placed on three years of probation with a six-month actual suspension and was ordered to take the MPRE within one year. The order took effect Dec. 28, 2006.

DeLoreto was convicted in 2003 of delivery of a controlled substance, a felony, and being under the influence of a controlled substance and contributing to the delinquency of a minor, both misdemeanors. He was referred to the State Bar Court’s alternative discipline program for attorneys in the discipline system who have substance abuse or mental health issues. He successfully completed the program.

DeLoreto and his son were arrested in 2000 in a motel room where they were smoking rock cocaine and drinking alcohol. While intoxicated, DeLoreto had given his son $300, knowing he would use the money to buy drugs from a local dealer. DeLoreto was cooperative with police and pleaded no contest to the three charges.

He has three prior convictions, at least two of which were related to substance abuse.

In mitigation, he has no prior discipline record, cooperated with the bar’s investigation, was suffering from substance abuse problems and successfully enrolled in the bar’s Lawyer Assistance Program. The court found that he was an exemplary participant in its alternative discipline program and has been clean for one year.
