ROSEMARIE T. HOLLANDER [#114175], 69, of Fountain Valley, was disbarred July 26, 2014 and ordered to comply with rule 9.20 of the California Rules of Court and make restitution.

Hollander stipulated to misconduct in two matters: the unauthorized practice of law in another jurisdiction, collecting an illegal fee and failing to cooperate in a State Bar investigation or file an affidavit of compliance with rule 9.20 in connection with an earlier disciplinary matter.

In the first matter, in 2010 and 2011, Hollander agreed to help a Connecticut homeowner modify his home loan despite the fact she was not licensed to practice in that state. Hollander also failed to respond to a State Bar investigator’s letter requesting information about the allegations made against her.

She was ordered to pay $1,747.50 plus interest in restitution. In mitigation, she entered into a pretrial stipulation with the State Bar, saving time and resources.

Hollander was previously suspended in 2013 for 18 acts of professional misconduct, including charging and collecting fees prior to fully performing loan modifications.

ROSEMARIE T. HOLLANDER [#114175], 68, of Fountain Valley, was suspended for two years, stayed, placed on three years’ suspension with an actual six-month suspension and was ordered to take the MPRE, comply with rule 9.20 of the California Rules of Court and to pay restitution. The order took effect July 24, 2013.

Hollander stipulated to misconduct in seven client matters, all of which involved loan modification services. The misconduct included: accepting advanced fees for loan modification services, failing to provide clients with an accounting, failing to perform legal services with competence, failing to respond promptly to a client’s reasonable status inquiries, failing to participate in or cooperate with a State Bar investigation and failing to return unearned fees.

Hollander worked as an attorney for the Juris Consult Law Group. In the matters she was disciplined for, Hollander agreed to seek loan modifications on behalf of her clients but collected fees prior to having completed all of the agreed upon services, a violation of state law. In some of the cases, Hollander agreed to return unearned fees but failed to fully do so.

In mitigation, she had no prior record of discipline and cooperated with the State Bar by entering into a stipulation. Hollander was ordered to pay $19,915 plus interest in restitution.
