May 18, 2006 STEPHEN L. BURTON [#113748], 51, of Sherman Oaks was suspended for two years, stayed, placed on probation for two years with an actual 30-day suspension and was ordered to take the MPRE within one year and prove his rehabilitation. The order took effect May 18, 2006. Burton stipulated to misconduct in four cases, all involving the unauthorized practice of law in another jurisdiction. He operated a Web site for his Foreclosure Recovery Center that claimed Burton could prevent foreclosure sales without regard to jurisdiction and that he would “defend†clients in need of protection from foreclosure. The Web site also claimed Burton could file Chapter 13 bankruptcies without regard to jurisdiction in order to save clients’ homes.In each of the cases, Burton took the cases of out-of-state clients but was unable to postpone or prevent foreclosure. One client’s house was sold at auction, two were told Burton was unable to negotiate a solution and the fourth negotiated a repayment plan with her mortgage holder in one day — a month after she hired Burton.He stipulated that he engaged in the unauthorized practice of law in other states by advertising legal services in other jurisdictions when he is admitted to practice only in California, by entering into fee agreements and accepting fees from clients in other states and by sending correspondence outside of California for clients living out of state. He also admitted that his Web site advertising was misleading and he failed to refund unearned fees until the State Bar intervened.Burton was publicly reproved in 1998 for failing to perform legal services competently or communicate with clients.In mitigation, he closed the Foreclosure Recovery Center and removed his advertisements from the Internet. |
