MARC RUSSELL LEVINE [#113671], 53, of Palm Desert was disbarred May 12, 2013, and was ordered to comply with rule 9.20 of the California Rules of Court.

Levine failed to comply with the terms of a 2011 disciplinary order that required he comply with rule 9.20. He was required to submit to the State Bar Court a declaration that he notified clients, opposing counsel and other interested parties of his suspension. Failure to submit an affidavit showing compliance is grounds for disbarment.

In the underlying case, Levine stipulated to 19 counts of misconduct in seven matters including failures to respond to reasonable client inquiries, perform legal services competently and refund unearned fees. He also practiced while suspended and entered into an improper transaction with a client.

In mitigation, Levine had been recovering from substance abuse and emotional problems and expressed remorse for his conduct.

MARC RUSSELL LEVINE, 52, of Palm Desert was suspended for two years, stayed, placed on three years of probation with a two-year actual suspension and until he proves his rehabilitation and he was ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. The order took effect Oct. 20, 2011.

Levine stipulated to 19 counts of misconduct in seven matters. The misconduct included failures to respond to reasonable client inquiries, perform legal services competently, return client files, refund unearned fees, comply with probation conditions or cooperate with the bar’s investigation. He also practiced while suspended, entered into an improper business transaction with a client and committed an act of moral turpitude.

He gave one client incorrect legal advice about at what point she would owe the other party costs if she dismissed her case, and did not inform her of the $31,752.86 the court eventually awarded the other party. He appeared at a mandatory settlement conference while suspended and did not keep another client informed of developments in his case. He allowed the statute of limitations to expire in a personal injury case, causing the client to lose the right to recover. He failed to return the unused portion of another client’s advanced fee. And he did not advise another client in writing that he had the right to speak with an attorney before loaning Levine $31,000, nor did he obtain his written consent to the terms of the loan.

Levine was suspended in 2010 after stipulating to three counts of misconduct stemming from being sanctioned while representing two defendants in Orange County Superior Court.

Levine stipulated to three counts of misconduct stemming from being sanctioned while representing two defendants in Orange County Superior Court. He missed a case management conference and the resulting hearing on an order to show cause and he was sanctioned. He didn’t pay the sanction or notify the bar, nor did he cooperate with the bar’s investigation of his misconduct.

In mitigation, Levine has no prior discipline record, he was suffering from emotional and financial problems and was evicted from his residence. He presented evidence that he failed to pay the sanctions because he cannot afford to do so.
